The first ever named complaint in this case came on May 7 ,2006 when Nandlal (father of Payal), accused Moninder of having hidden his daughter but police did not act on this complaint for seven months and in htese seven months 8-10 more children went missing.In fact Nandlal had to take the help of the court just to get his F.I.R registered. He was virtually thrown away from the SSP\'s house when he went there a third time begging for help. These are facts which finally came to light. But what did not come out was that this SSP was R.K.S.Rathore and not Piyush Mordia. Piyush Mordia had been transferred from Noida on April 26, 2006 whereas Payal disappeared on May 7, 2006. Is it fair to hold an offficer (who was transferred to another district)responsible for the misdeeds of his successor? |

Was there an unspoken understanding between RKS Rathore, Dinesh Yadav and B.P.Singh because of which Rathore never recommended action against any one of them.? Did B.P.Singh not write the missing reports because of the instructions of his seniors? Was it due to the instructions from his SSP that Dinesh Yadav did not register Payal\'s case for a long time and filed an affidavit in favour of Moninder singh Pandher & Surinder Koli and let them off inspite of a named report against them? |

The subordinate officers during whose tenure lapses took place and who were finally held responsible by the court as well - namely Dinesh Yadav (Deputy SP), B. P. Singh Yadav (Station officer) and Simaranjeet Kaur (sub inspector) - all of them got posted to Noida only after Piyush Mordia\'s transfer- none of them has ever worked with Piyush Mordia in his entire career. They were never supervised by him. How could he be held responsible for their lapses or actions? Was he made a scapegoat? |

It is surprising that an officer in a position of responsibility lied to protect his skin. S.S.P of Noida R.K.S.Rathore, in his written statement to the government of Uttar Pradesh has stated that due to his efforts, no incident took place in and after September- A blatant lie as the following four children went missing after September. It is a different story altogether that these were the only cases in which not even a missing report was registered. The C.B.I. has matched the D.N.A. in all these cases. These incidents thus stand verified.

Instead of Rathore it , was Piyush Mordia who was held responsible for the non registration of the above mentioned cases. These cases had taken place only after Mordia’s tenure in Noida had already got over and he was not responsible for their non registration. But due to the deliberate foul play by some senior officers facts were misrepresented. |

| What’s unknown is th fact that a few days before Satish Mishra took the seven chosen few to meet mulayam, he had organized a pro R.K.S. Rathore dharna in Nithari, that had invited vocal protests from several victims. Says Nazreen Devi, whose 11 - year - old Rahulis one of the missing: “We were really annoyed with him for having organized an agitation in support of Rathore. This is injustice. Didn’t we suffer as well? Why were we discriminated against? I had told him that Rathore was morally responsible for the shoddy job done by his juniors. |

| DIRTY GAMES POLICE PLAYED |
| When Rathore and Dinesh Yadav realized that they might be held responsible for the non registration of missing complaints, they decided to plant a few people . They managed to find one such person. The name of this person was Sheikh Aslam. They promised him compensation money and land if he stated that his son went missing during the tenure of Rathore’s predecessor so that the blame for not lodging the missing report could also be shifted on his predecessor. Fortunately for Mordia, the truth came out. Not only did the residents of Nithari on record state that Sheikh Aslam ,along with his son Sheikh Raza never resided nor visited Nithari, even Surendra in his interrogation accepted committing all the murders except for Sheikh Raza’s whom he emphatically stated that he had not killed. The D.N.A match and the C.B.I ‘s report was a further proof of this fact. |

Nithari killings were perhaps the most gruesome killings of the year. Everyone was shocked that in the present day and age such ghastly occurrences can still take place. Guardians of such inhuman criminals are as guilty as the perpetrators of such heinous crimes. When the Nithari events were uncovered in the wake of the chaos and confusion that was created the people who had shielded these two accused escaped without a scratch. Unfortunately these people were cops who had the charge of Nithari when the shameful episode came to light. These cops misrepresented the facts and blatantly lied not only to the media but also to the government. Resultantly some other cops who were nowhere in the picture came under fire. As the year comes to an end, this site is homage to all those innocent children who were slaughtered in Nithari. This is also an attempt to show how money, muscle and power can save the guilty even in the most sensitive of cases. In brief we attempt to analyse the sequence of events and also try to show where the lapses took place. May the truth finally prevail and may the souls of these victims finally rest in peace.

| THE PLOT THICKENS |
| S.S.P.Rathore did not take any action against the nithari station officer B.P.Singh who was the only one in whose tenure four children went missing and still even a missing persons report was not lodged. Probably,Rathore- The senior superintendent of police, Dinesh Yadav-the circle officer,B.P .Singh-the station officer, Simranjit Singh –the chowki incharge of nithari all realized the gravity of the situation. If media came to know about their lapses they would all be under fire – It appears that they decided to save each others skin–Station officer B.P. Singh threatened that if strict action was taken against him, he would open his mouth and reveal that it was Rathore who had phoned him and asked him to release Moninder and Surinder and then he indicatively conveyed to Dinesh Yadav that he would be left with no option but to reveal to the press that Dinesh had gone to Allahabad to file an affidavit in favour of Moninder in the Allahabad High Court and that Moninder had paid for his to and fro journey –The travel vouchers were later found by the C.B.I in their raid. |

| When Moninder was initially arrested, an industrialist had called up the S.S.P –Mr Rathore, after which Rathore called up the police station and ordered Moninder and Surinder's release . After that,despite the court's orders every attempt was made to protect Moninder and delay his arrest. Since then , the noida police never called Moninder for questioning.This industrialist was not questioned by the Noida Police even after the case came to light. |

| BIG MISTAKE |

| The most amazing fact is that not only were the cases not registered during S.S.P. R.K.S. Rathore's tenure , the cases which had been registered during Mordia's tenure and in which search was being done were closed after putting a final report on them. e.g. Jyoti and Beena whose missing case had been registered and search was going on when Rathore took over .On 25-5-2006, and 28-5-2006, the final report was put in these cases and the investigation closed on Rathore's orders .It is a mystery as to why when both children had not been found the investigation was closed. |

| One of the most heinous crimes in recent times was uncovered in December 2006 in Nithari when the skulls and bones of missing children were discovered. There was immediate public outcry and extensive media coverage. The police, in a massive show of incompetence, allowed parents and media into the house of the accused, thereby destroying important pieces of evidence. But what was more shameful that instead of conducting a fair inquiry and punishing the guilty, the UP Government and police went into massive cover up mode, to the extent to suspending a senior police officer who wasn't even responsible for Noida when this tragedy unfolded, in order to protect the police officers who were really guilty. | Stung by the negative media coverage, the State Government of UP immediately went on the defensive, and in the next few days, sent an enquiry committee to Nithari. The enquiry committee that was looking in the lapses by police relied on the information given by RKS Rathore and Dinesh Yadav and met only those five tutored persons (kins of the victims) who were made to meet them by these officers in a very planned manner. Dinesh Yadav and B.P.Singh ensured that Nandlal (father of Payal) is kept away from the enquiry committee.The committee had been misled by the SSP of Noida RKS Rathore and the circle officer Dinesh Yadav.The committee then submitted a report to the UP Government. Based on that report, the UP Government then dismissed some police officers and suspended a few but the then SSP of Noida, R K S Rathore, was left untouched, and continued as in charge of the investigation.

| WHAT AN IRONY |

The enquiry committee recommended action against some officers but it soon realized its mistake when it came to know about the case of Deepika alias Payal and other cases from some of the newspapers.But the committee had already come back to Lucknow and action had already been taken by the state government on the basis of its first report. The committee was therefore not in a position to withdraw its first report.Instead it came up with another report (though the committee never made a second trip to Noida) in which the details of the case of Payal were given and the lapses of Rathore, Dinesh Yadav and B.P.Singh were pointed out. The committee had no option but to call its first report as the interim report( in order to justify its earlier recommendations) and the second one as the final report. But the government now paid no attention to the committee's second report. Here was a classic example of a case in which action had been taken against the innocent and the guilty had gone unpunished. |

What an ironical situation –the same cops whose involvement was beyond doubt were investigating the case and the ministers of the state government were praising their efforts.In fact Shivpal Singh Yadav, brother of chief minister, visited Noida on January 4 ,2007 and described the ghoulish Nithari murders as small and routine incidents. He praised the present group of offficers for opening the case. (Times of India jan 5, 2007. Navbharat Times jan 5, 2007) Everyone was hand in glove and so scapegoats were needed and it was decided that one senior officer needs to be made a scapegoat as only then the press and the political parties would remain silent. |

| The sub inspector who worked out the case -Vinod Pandey was suspended by Rathore and later dismissed from service.When Rathore was asked about his lapses, he took the credit for solving the case. If Rathore's lapses could be forgiven on account of his subordinates having worked out the case then why was the officer who actually worked out the case dismissed from service? |

The Noida police did not bother to even investigate( the drain where body parts were discovered)thoroughly.As a result, when the C.B.I.,took over , they discovered a lot of bags with skeletons.(When asked why they did not investigate the nala thoroughly, the then S.S.P Rathore said that they were to busy crowd controlling to investigate properly.- in other words, he had time to give exclusive interviews and be a part of chat shows on various channels but did not have time to investigate the most sensitive case of the year. He very shrewdly succeeded in misleading the media by lying about the dates of the disappearances and put the entire blame for the lapses on his predecessor who till then was nowhere in the picture. |
